DEFINITIONS
The terms and expressions identified by capitalisation in these General Terms and Conditions of Sale have the meaning indicated below (whether used in the singular or plural):
"General Terms and Conditions of Sale or General Terms and Conditions": refer to this document,
"Special Conditions of Sale or CPV": means special conditions attached to a specific sale, the terms of which cancel or partially replace these GTCS,
"Order": means the customer's purchase of one or more product(s) made by using the website,
"Website": means the website accessible at www.wood-and-luxe.fr/com
"Product": means a product offered for sale on the website, "Customer": means a consumer natural person who uses the website and acquires one or more product(s), for his personal needs, through the website by having previously adhered to the General Terms and Conditions of Sale.
Preamble
The general conditions of sale (hereinafter "GTC") are applicable exclusively to the online sale of wood-and-luxe products on the wood-and-luxe.fr/.com website.
These General Terms and Conditions of Sale contracts for the online sale of wood-and-luxe's products to buyers who are consumers (customer") and constitute with the order form, and the Special Conditions of Sale if applicable, the contractual documents enforcible against the parties, to the exclusion of any other documents, prospectuses, catalogues or photographs of the products that are only indicative.
The GTC are made available to customers on this site, where they are directly searchable.
We recommend that you take the time to read the GTC because they determine the contractual relationships related to your use of our site and the services offered on it. By checking the box provided for this purpose, you indicate that you have read our General Terms and Conditions of Sale and that you accept them.
Any order placed on the website requires the customer to accept the GTC as a whole beforehand and without reservation. In case of disagreement with the terms and conditions of the GTC, the customer must not use the website.
Price
All our prices are displayed in currency accepted including VAT and must be paid (as well as any applicable taxes including all duties and taxes paid in your name and on your behalf at the time of customs clearance of the products). The selling price does not include delivery costs in metropolitan France or Europe. That is to say, the furniture will be delivered by appointment in front of your entrance, outside and on the ground floor. The assembly is to be done by you. Other delivery options are available on the summary page before final validation of the order.
We reserve the right to change prices at any time, while guaranteeing you the application of the price in force on the day of the order.

PURCHASE OF PRODUCTS / ORDER
Order procedure Orders are placed and received via email or via the Internet and processed by wood-and-luxe. To place an order, after completing your configuration or filling your virtual shopping cart by indicating the selected products and the desired quantities, you must click on the "order" button and provide delivery and payment method information.
Payment methods (Pay)
Payment is made in full or with a deposit of 50% at the time of order. In addition to being able to pay for your purchases safely with your credit card, the customer has the possibility to check the details of his order and its total price and to return to the previous pages to correct any errors or possibly modify his order (in accordance with Article 1369-5 of the Civil Code).
Confirmation of the order entails acceptance of the GTC and formation of the contract. An email acknowledging receipt of the order and its payment is sent by the Company as soon as possible. Any Product that is part of the same order that is not included in the order confirmation email we sent you does not form part of this contract.
At this stage, Special Conditions of Sale may apply. Refusal of these by the Customer entails the cancellation of the previously formed contract, with the full refund of the sums already paid by the Customer.
Before placing an order on our site, it is your responsibility to verify and determine your full capacity to receive the products and in particular to ensure that the ordered product can be delivered to your address without any problems. It is therefore your responsibility to check the dimensions of rooms, passages, stairs and other doors and to ensure that delivery can be made without other specifications.
All the information required on the page before validation of the order must be filled in with precision and accuracy. We cannot be held responsible for a delivery delay due to an error related to the delivery address or telephone number. Any additional costs or costs related to complications or delivery delays will therefore be added to your order invoice.
Modification of the order any change (including change in the delivery address, spelling of a name, your telephone number or any other specific information) to your order after confirmation it by our services is subject to our acceptance. Order cancellation The company produces customised furniture according to the specifications given by customers. These customized products are not refundable.
Under the provisions of Article L121-21-8 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalised.
PRODUCT DESCRIPTION
On our site, you can configure your customised furniture by contacting us directly by e-mail at woodandluxe@gmail.com. The materials used and technical information are described on specific pages. We strive to represent the full characteristics of the products as faithfully as possible using photographs and descriptions provided.
Before placing an order, we therefore invite you to carefully study the description and characteristics of the product.
Photographs illustrating the products as well as the visuals of the configurator do not constitute contractual documents.
SPECIAL CONDITIONS OF SALE
In some cases, Special Conditions of Sale may be attached to the contract. CPVs replace, for the clauses they cover, the GTCS. CPVs are sent to the Customer by email at the address entered during registration, or by any means deemed necessary by wood-and-luxe. The customer accepts the PVCs associated with the Contract by replying to the email containing the CPVs with the mention "Voucher for agreement and acceptance of the special conditions of sale", and provides any additional information requested. PVCs apply to only one contract, unless otherwise specified.
Contract
Conclusion of the contract The order will not be considered final until the Company sends the customer the confirmation email referred to above, and the sale of the product(s) will only be recognised after payment of the corresponding price by the customer.
Archiving and proof the archiving of communications, purchase orders and invoices is carried out on a reliable and durable medium so as to constitute a faithful and durable copy. These communications, purchase orders and invoices can be produced as proof of the contract.
Cancellation of the order If an order is delayed or cannot be manufactured for any reason (insufficient number of orders, problems related to manufacturing, quality or any other nature), we will do our best to inform you quickly.
Payment
Payment methods? The price is due in full at the order confirmation. Wood-and-luxe uses one of the most secure systems available on the Internet to protect all valuable data related to your payment.
A credit card and related information are required to make the payment. Payment for any order must be made only by means of a credit card issued by one of the companies listed on the payment page. You certify to us, at the time of payment, that you are the credit card holder and that you have sufficient funds to pay for the Order. Payment of the Order by the Customer is irrevocable.
The sale will then be processed as soon as you click on the "Confirm Order" button. You will receive an email from us confirming the sale, availability of the product and the average delivery date to be expected.
We reserve the right to refuse to process a transaction for any reason or to refuse the service to anyone at any time and in our sole discretion.
We cannot be held liable to you or a third party for refusing to process a transaction or suspend any transaction after processing has begun.
Non-payment and retention of title the products ordered remain the property of the Company until the sale price is fully paid. By express agreement and unless otherwise granted by the company, any failure or delay in payment will result in (i) the immediate liability of any amount remaining due, regardless of the scheduled due date, without any formality or prior formal notice, (ii) the payment by the Customer of late payment at the rate of three times the legal interest rate in force (this rate will be updated according to the In the event of delivery and non-payment, the company has the right to claim ownership of the products ordered, the customer undertakes to return any unpaid Product, all costs being then borne by him.
Delivery
Delivery costs: Delivery costs vary depending on the place of delivery. Additional charges may be added to the order for any planned delivery to an isolated or hard-to-reach place that would require special attention. Fees that are calculated based on the delivery address will be indicated on the summary page before payment of the order. The delivery address designated by the customer may be different from the billing address.
Delivery time: delivery time may vary depending on the products ordered, the quantity of orders and the availability of transport vessels. Our manufacturing method on demand causes this delay to vary from 10 to 12 weeks on average. This is an average, sometimes the delay is longer or conversely much shorter. All time estimates given at the time of validation and confirmation of the order are subject to change. In the event of a change in the delivery time, we will do our best to contact you and inform you of any changes.
Delivery methods .The products are delivered to the address indicated on the order form. Any complaint of delivery error must be made by the customer to the company on the same day of delivery or at the latest on the first working day following delivery. Depending on the weight, size and quantity of products, we may use different carriers and services to deliver your order to you. The carrier will contact you and you will agree together on a delivery slot. You will need to sign a delivery confirmation upon receipt of the products, after verifying the conformity and packaging status of the products.
Product compliance We invite you to open and verify your order on the day of its delivery and to inform us immediately of any possible damage suffered during transport. You must ensure that all products and components of a product have not suffered any damage before proceeding with their assembly. It is your responsibility to check that the delivered products reach you in perfect condition before signing the delivery.
In the event of delivery of an item that does not conform to your order, damaged or incorrect, we invite you to contact us as soon as possible and no later than 3 days from delivery, to agree on a refund or replacement. We may ask you to provide us with a photo of the damaged parts for our files and to allow us to take appropriate action. Returned products must be returned to us in their original packaging or in equivalent packaging.
GUARANTIES
Legal guarantee all products supplied by the company benefit from the legal guarantee of conformity provided for in Articles L.211-4 to L.211-14 of the consumer Code and the legal guarantee of hidden defects provided for in Articles 1641 to 1649 of the Civil Code. Under these guarantees Wood-and-luxe undertakes, at the customer's choice, to reimburse or exchange defective or non-order products within 6 months of delivery. The warranty does not cover damage, breakage or malfunction resulting from non-compliance with the precautions for use.
After-sales service claims made under guarantees should be sent by mail to woodandluxe@gmail.com. Products covered by the warranties must be returned new, complete and in their original condition and packaging (or equivalent packaging) after receipt and confirmation of the complaint by the after-sales service.
RESPONSABILITIES
The company cannot be held liable in the event of non-performance or poor performance of the contract due either to the buyer, to the insurmountable and unpredictable fact of a third party to the contract, or to force majeure.
No regulations specific to the country of delivery and/or consultation of the website may be opposed to the Company.
RESOLUTE CLAUSE
The resolution of the order in the cases provided for in these GTC will be pronounced by registered letter with acknowledgement of receipt and will be acquired as of right without judicial formality.
APPLICABLE LAW
In the event of a dispute, the law applied will be that in force in the country where our company's head office is located in the District Court of Foix 14Bd of S,09008
